Advocate Clerks are employed by advocates to provide assistance to their legal business. The role and responsibilities of the clerks are extensive and mostly depend on the experience of the clerk. Bangladesh Bar Council Rules require Advocate Clerks to be registered under the Rules. No Advocate shall engage any person as a Clerk unless he is registered in the manner contemplated by the Rules.
Who will register?
The respective Bar Associations are the Registering Authority for the registration of Advocate Clerks. Each Bar Association may run the registration process by itself or through an Executive Committee specially formed for this purpose.
What are the requirements?
All applicants must have passed SSC or equivalent Examinations.
The applicant has to submit an application in plain paper to the Bar Association concerned with the following documents:
- A Certificate from the Advocate who desires to employ the applicant as Advocate Clerk.
- A Certificate to show that the applicant successfully passed the SSC or an equivalent examination.
- Character Certificates from two responsible persons.
- The applicant must submit a statement in his own handwriting which must be supported by an affidavit that
- He is willing to employ himself as Registered Clerk of the Advocate concerned, and
- Provide his/her service exclusively to the Advocate concerned.
- His/her Date of Birth, Father’s Name, Permanent and Present Address.
If, the applicant was already registered for an Advocate and willing to employ himself under a different Advocate then the applicant must also submit a Certificate of Good Conduct from the previous employer.
What happens after making the application?
If the Registering Authority concludes that the applicant is fit and proper to be employed as a Registered Clerk, the Authority will register the applicant and issue a Card that is non-transferable and valid till 15th December of each calendar year.
Renewal of the Registration:
The registration must be renewed each year. The registered Clerk must submit the following documents with the renewal application:
- A Certificate from the Advocate who desires to employ the applicant as Advocate Clerk.
- A Certificate to show that the applicant successfully passed the SSC or an equivalent examination.
- Date of Birth, Father’s Name, Permanent and Present Address.
